Terms of Service

1. The EvolvPass Platform

EvolvPass is a platform that enables customers to discover, book, and pay for services offered by independent businesses and professionals ("Businesses").

EvolvPass does not provide the services offered by Businesses and is not responsible for their performance, quality, or conduct.

2. Eligibility

You must be at least 18 years old to use EvolvPass. By using the Platform, you confirm that you are legally capable of entering into a binding agreement.

3. Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account

You agree to provide accurate, current, and complete information and to keep it updated. We may suspend or terminate accounts that violate these Terms.

4. Bookings & Payments

4.1 Bookings

Bookings made through EvolvPass constitute a direct agreement between the customer and the Business.

4.2 Payments

Where applicable, payments are processed via third-party payment providers (e.g. Stripe). EvolvPass does not store full payment card details.

4.3 Cash Payments

Some Businesses may accept cash payments. Refunds do not apply to cash payments unless explicitly stated by the Business.

5. Cancellations & Refunds

Cancellation eligibility depends on:

• The Business's cancellation policy
• The time remaining before the scheduled service

Key rules:

• Cancellations are not allowed after a booking has started.
• Refund eligibility (for online payments) depends on the applicable cancellation cutoff.
• Late cancellations may result in no refund.
• Cash bookings are not refundable.

Exact eligibility and messaging are shown at the time of cancellation.

6. Businesses' Responsibilities

Businesses are solely responsible for:

• Their services
• Pricing, availability, and descriptions
• Compliance with applicable laws
• Customer interactions and fulfillment

EvolvPass is not liable for disputes between customers and Businesses.

7. Acceptable Use

You agree not to:

• Use the Platform for unlawful purposes
• Attempt to access systems or data without authorization
• Interfere with platform functionality
• Misrepresent your identity

8. Intellectual Property

All platform content, branding, and software are owned by or licensed to EvolvPass. You may not copy, modify, or distribute any part of the Platform without permission.

9. Termination

We may suspend or terminate your access if you violate these Terms or misuse the Platform. You may stop using EvolvPass at any time.

10. Disclaimers

The Platform is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, EvolvPass is not liable for:

• Indirect or consequential damages
• Loss of data, profits, or revenue
• Acts or omissions of Businesses or users

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
